Gmu Fall 2023 – After decades of efforts by some to slow the expansion of intellectual property rights (IPRs) around the world, policymakers and courts in some countries have responded by placing greater restrictions on intellectual property rights. Now that such limits have been in place for a few years, researchers can begin to measure the impact on innovators, creators, and the economy at large. C-IP

The conference included a keynote lunch with a mock speech by Senator Thom Tillis of North Carolina, and there were 7 expert panels covering various types of copyright, as well as antitrust and national security. C-IP

Hours Of Operation

Concluded the conference with a special closing reception for John F. Witherspoon. Professor Witherspoon is a member of the C-IP2 Advisory Board, Professor and Director Emeritus of Scalia Law’s Intellectual Property Program, which he has directed for many years. John has been involved with Mason for 30 years, having first joined the faculty as an adjunct in 1992. Thank you to those who joined us in thanking Professor Witherspoon for all his work for our school!

Is excited to present the Seventh Annual Law Rocks Washington DC to the official conference program! Law Rocks DC takes place at the club at 9:30 on September 22, 2022 and features eight bands of legal professionals performing to benefit local nonprofits. Conference registrants can receive a discount on their conference tickets.

Several drug-specific, sui generis legislative and regulatory regimes already exist, but many others have been proposed in recent years in an attempt to facilitate market entry of follow-on therapies. Some of these proposals would directly classify certain practices using pharmaceutical patents and other exclusivity as antitrust violations. Almost all other proposals explicitly or implicitly rely on antitrust laws and theories to support the idea that loosening patents and regulatory exclusivities is necessary to lower drug prices. The clear thinking behind all these proposals is that, without this exclusivity, there will be increased ‘competition’ in the pharmaceutical market.

The standard essential patent policy (SEP) continues to have a significant impact on innovation and development. This box explores some of the active issues facing IP owners today. The first is China’s use of countersuits and the subsequent response from US and European courts. The second is the divergence between the pending FTC/DOJ policy change on SEPs, the EU’s WTO complaint against China’s SEP policy, and a possible move on the EU’s SEP policy. The third is the expansion of the SSO licensing model / FRAND in the automotive sector (which has raised antitrust concerns in US courts and EU regulators);

With the pending implementation of the Digital Markets Act (DMA) in the EU, regulatory tools for interoperability, data sharing and product design control have moved to the forefront of both antitrust and intellectual property rights debates. Following the EU’s example, the US Congress is poised to pass similar legislation, which will have a far-reaching impact on innovation incentives and basic intellectual property rights. Now more than ever, policy debates are needed about the wisdom of government as the guardian of the digital marketplace and whether innovation can flourish under such a heavy-handed regulatory approach.

For more than a decade and a half, the US patent system has been undermined by a series of judicial and legislative actions. Economic theory and history expect this policy trajectory to distort the innovation economy by diverting R&D dollars away from patent-dependent technology sectors. Our partners will present data showing how the VC and tech markets have responded as expected, moving venture capital away from high-cost and long-term R&D projects to the life sciences and IT hardware sectors that offer the greatest social returns.
